Tracy Morgan update: Wal-Mart settles with McNair's family for $10m; Morgan misses 'SNL' tribute

While Tracy Morgan of "3o Rock" and "Saturday Night Live" fame recovers from a traumatic brain injury and several broken bones, James McNair's family's settlement figure has finally been revealed.

Legal documents filed last month in Westchester's Surrogate Court reveal that the amount paid by Wal-Mart in an out-of-court settlement with McNair's family is $10 million, reports Reuters. These sums were awarded to James McNair's two children, 19-year-old Danita and 26-year-old Jamel. The comedian's family and the retail giant kept the amount under wraps as a result of the financial damage to the company and concern over the children's safety.

A spokesperson from Wal-Mart told Reuters that, "We are glad to have reached an agreement but we can't discuss the terms and conditions of the settlement. We deeply regret the loss of Mr. McNair as a result of the accident."

McNair was also known by his stage name as Jimmy Mack. E! News reports that the family's lawyer, Daryl Zaslow, pocketed nearly $3 million as legal fees. Zaslow also shared that reaching the settlement figure was very difficult since McNair wasn't earning very well at the time of his death. Wal-Mart did not entertain the requested settlement amount initially and it took several months of heated discussions to finally acquire it.

Danita McNair expressed her gratitude towards Zaslow in assisting the family. She said in an affidavit that no amount of money can replace her father's life, but she was grateful to her lawyer for securing such a vast amount.

Meanwhile, Salon reports that Tracy Morgan wasn't emotionally ready to watch his tribute on "Saturday Night Live". "SNL" and "30 Rock" alum cast members were present to honor the comedian.

Morgan, McNair and three other passengers were traveling on a limousine bus when a Wal-Mart truck crashed into them at the New Jersey Turnpike. Nair died while Morgan sustained injuries. He is currently in recovery and has sued Wal-Mart. It was revealed that the Wal-Mart driver was allegedly driving without sleep and was over the driving limit. However, Wal-Mart alleges that passengers in the bus weren't wearing seatbelts.
