Kylie Jenner vs. Kylie Minogue: Who owns the name?

What's in a name? Apparently a significant lot, judging by the extent to which the two Kylies, Jenner and Minogue, are taking their battle over who really owns the right to the first name "Kylie."

Jenner, teen star of "Keeping Up With the Kardashians," filed at the US Patent and Trademark Office (USPTO) to be granted the trademark to the name in the United States, with the application published for opposition in August of last year. Minogue, the Australian singer, challenged this application by filing a notice at the USPTO in Feb. 22 through her business team, Australian firm KDB.

Minogue's opposition to Jenner's application is based on claims that if the USPTO granted the latter trademark for the moniker, it would cause confusion among fans and adulterate the former's brand. The 47-year-old pop star also owns trademark registrations for entertainment services that the 18-year-old reality TV personality has also applied for. The documents filed also present several of the logos that have already been used and associated with Minogue over the years — decades in fact. For instance, she has owned the website www.kylie.com since August 1996. The World Intellectual Property Review also indicates that Minogue owns existing trademarks for music recordings as well.

The opposition notice also mentions Minogue's work hitting the charts in the United States for 1988 "The Loco-Motion" and her 2004 Grammy award for "Come Into My World," though, by her admission, her music has not really penetrated the U.S. market significantly.

The papers also cite Jenner as "a secondary reality television personality who appeared on the television series 'Keeping Up With the Kardashians' as a supporting character ..." and that she "is active on social media where her photographic exhibitionism and controversial posts have drawn criticism from, e.g., the Disability Rights and African-American communities."

In contrast to the comments on Jenner in the documents for opposition, Minogue is described as an "internationally renowned performing artist, humanitarian, and breast cancer activist."

Jenner, on the other hand, is working to obtain the trademark to her first name for advertising services in the light of her growing beauty and clothing brands.

Taking her battle to another venue, Minogue tweeted on Feb. 28, "Hello ... My name is KYLIE #lightyears," to which her fans responded, "The one and only."
